Public transport companies handle your data confidentially.
The protection of your personality and your privacy is an important concern for us, the public transport companies. We guarantee that your personal data will be processed in accordance with the applicable provisions of data protection law. With the following principles, the public transport companies set an example for the responsible handling of your data.
You decide how your personal data is processed.
Within the legal framework, you can refuse data processing at any time, withdraw your consent or have your data deleted. You always have the option of traveling anonymously, i.e. without your personal data being recorded.
When processing your data, we offer you added value.
Public transport companies use your personal data to offer you added value along the mobility chain (e.g. tailored offers and information, support or compensation in the event of disruption). Your data will therefore only be used for the development, provision, optimization and evaluation of our services or for maintaining the customer relationship.
Your data will not be sold.
Your data will only be disclosed to selected third parties listed in this privacy policy and only for explicitly stated purposes. Third parties commissioned with data processing are contractually obliged to comply with our data protection standards.
We guarantee the security and protection of your data.
Public transport companies guarantee the careful handling of customer data and the security and protection of your data. We take the necessary organizational and technical precautions to ensure this.

Who is responsible for data processing?
Brienz Rothorn Railway AG is responsible for processing your data. As Brienz Rothorn Railway public transport operator, we are required by law to provide so-called direct services. For this purpose, certain data is exchanged within the transport companies (TU) and public transport associations as well as with third parties that provide public transport services, and stored centrally in databases operated jointly by all transport companies and public transport associations. We are therefore responsible for individual data processing together with these transport companies and associations. Further information on the individual data processing operations can be found in the section "What does joint responsibility in public transport mean?".

Why do we collect personal data?
We are aware of how important it is for you to handle your personal data with care. All data processing is only carried out for specific purposes. These may arise, for example, from technical necessity, contractual requirements, legal regulations, overriding interest, i.e. for legitimate reasons, or from your express consent. We collect, store and process personal data to the extent necessary, for example to manage the customer relationship, distribute our products and provide our services, process orders and contracts, make sales and issue invoices, answer questions and concerns, provide information about our products and services and market them, provide support in technical matters and evaluate and further develop services and products. For more detailed information on which data is processed for which purposes, please read the following sections.
What data is stored and what is it used for?
When purchasing services
For contractual reasons, we require personal data for online orders or the purchase of certain services and products in order to provide our services and process the contractual relationship. For example, when purchasing a subscription or a one-way ticket. When purchasing personalized services, we collect the following data - depending on the product or service - whereby mandatory information is marked with an asterisk (*) in the corresponding form:
- Personal photo
- Gender, name, e-mail address, of the person making the purchase or traveling
- Other details such as postal address, date of birth
- Telephone number
- Payment method
- Agreement to the GTCs
In order to process the contractual relationship, we also collect data about the services you have purchased ("service data"). Depending on the product or service, this includes the following information:
- Type of product or service purchased
- Price
- Place, date and time of purchase
- Purchase channel (Internet, vending machine, counter, etc.)
- Travel date or period of validity and departure time
- Place of departure and destination
To ensure that we can always reach you by post, we check your address with Swiss Post - provided you have agreed to this with Swiss Post - and update it if necessary.
Data generated when purchasing services is stored in a central database (see the section on joint responsibility in public transport) and also processed for other purposes, including marketing and market research purposes (for more information, please refer to the relevant sections of this privacy policy).
In addition, the data is used as part of ticket inspection to identify the holder of a personalized ticket and to prevent misuse (for more information, please refer to the section "When checking services" and the section on joint responsibility in public transport).
The data is also used to provide our Après Vente service, to identify and support you in the event of concerns or difficulties and to process any claims for compensation.
The data is used to distribute the revenue generated by the purchase of tickets fairly among the companies and associations of National Direct Transport.
For group trips, we will inform you by e-mail about your group reservation and any delays or cancellations.
Finally, we analyze their data anonymously in order to further develop the overall public transport system in line with their needs.
Insofar as the EU GDPR is applicable, our legitimate interest and the necessity for contract processing form the legal basis for this processing of personal data.
Customer and season ticket data is required and processed during the inspection of services
in order to safeguard revenue (checking the validity of travel or discount cards, debt collection, combating misuse). The transport companies and associations are therefore entitled to process all data (ticket and control data as well as any particularly sensitive data in connection with all types of travel without a valid ticket, such as passengers with a partially valid ticket) for the entire control and collection process, travelers with invalid tickets or travelers with forgotten tickets and discount cards and any misuse) of the travelers or contractual partners and to store them for the periods defined by data protection law and to exchange them with other transport companies and associations (in the case of international tickets or discount cards also across borders). The following provisions apply to individual services or carrier media:
SwissPass card
When using the physical SwissPass card as a carrier medium, no control data is stored (exception see SwissPass Mobile).
SwissPass Mobile
When using the SwissPass Mobile application, the provisions that are acknowledged upon activation of SwissPass Mobile apply (see separate data protection declaration): Registration, activation and control data that is generated when SwissPass Mobile is used. As soon as SwissPass Mobile is used, this data is also collected for the SwissPass card. The retention period for registration data is eighteen months after deactivation of SwissPass Mobile or after expiry of the SwissPass card. The activation and control data of SwissPass Mobile and the SwissPass card are stored on control devices for one day and in the control database for thirty days. If there are indications of misuse, the maximum retention period for activation and control data is ninety days. Travelers who misuse SwissPass Mobile will be excluded from SwissPass Mobile for twelve months. After this period, the use of SwissPass Mobile is possible again. After a further twelve months, the traveler's exclusion file will be deleted.
Electronic tickets
When electronic tickets (e-tickets) are used, control data is stored in SBB's central control data server. This data is stored for 360 days to combat misuse and for measures to prevent misuse and fraudulent refunds. Insofar as the EU GDPR is applicable, our legitimate interest and the need to process the contract form the legal basis for this processing of personal data.
In the event of misuse
In the event of travel without a valid ticket, the data will be stored in a separate database and in a jointly operated register. Passengers or contractual partners acknowledge that if any misuse or forgery is discovered, the transport companies are authorized to make the relevant personal data available to all internal bodies affected by the misuse and to other transport companies, so that misuse can be ruled out or confirmed and further misuse can be prevented. Different time limits apply to the processing of the aforementioned data in accordance with the Federal Passenger Transportation Act (PBG). The data is deleted as soon as it is established that the person concerned has not caused a loss of revenue, and after two years if the person concerned has paid the surcharges and has not demonstrably traveled without a valid ticket during this period. The data may be stored for a maximum of ten years if it is required for the enforcement of claims against this person, and insofar as the EU GDPR is applicable, Art. 20a PBG and Art. 58a VPB form the legal basis for this processing of personal data.

When you visit our website, the servers of our hosting provider temporarily store every access in a log file. The following technical data is collected:

We retain contract data for as long as required by statutory retention obligations. Retention obligations that oblige us to retain data arise from accounting and tax regulations. Where is the data stored?
Your data is generally stored in databases within Switzerland. In some cases listed in this privacy policy, however, the data will also be passed on to third parties based outside Switzerland. If the country in question does not have an adequate level of data protection, we ensure through contractual arrangements with these companies that your data is adequately protected by these companies.
What data is processed in connection with marketing?
If you consent, we use your customer data (name, gender, date of birth, address, customer number, email address), your performance data (data on purchased services such as season tickets or one-way tickets) and your click behavior on our websites or in emails that you have received from us for marketing purposes. With regard to the evaluation of click behavior, please also refer to the section on tracking tools. We evaluate this data in order to further develop our offers in line with your needs and to provide you with or display information and offers that are as relevant as possible (via e-mail, letter, SMS, push messages in the app and personalized teasers on the web, in person at the ticket counter). For this purpose, we only use data that we can clearly assign to you, for example because you have registered or identified yourself on our website with your login and purchased a ticket. We also use methods that predict possible future purchasing behavior based on your current purchasing behavior. The legal basis for this processing is our legitimate interest. In certain cases, contact may also be made by SBB or another company involved in direct transport under strict conditions. Please refer to the information in the section on "Joint responsibility in public transport". You can refuse to be contacted by SBB (e.g. in connection with your Swiss Travel Pass or Half Fare Card) or by other public transport companies at any time. What data is processed for market research purposes?
We conduct market research in order to continuously improve the quality of our services and offers. If you agree, we may use your contact details for customer surveys (e.g. online surveys). If you do not wish to be invited to take part in such surveys, you have the following options:
- Every e-mail that you receive from us or other public transport companies contains an unsubscribe link that you can use to unsubscribe from further messages.
- You can also subscribe or unsubscribe at any ticket counter or by phone on +41 33 952 22 11 or by e-mail at info@brb.ch.
We may also use technical means to analyze your personal customer data for the purpose of market research. In this case, the data will be anonymized as soon as the processing purpose allows this

What rights do you have in relation to your personal data?
You have the following rights in relation to your personal data:
- You can request information about your stored personal data.
- You can request that your personal data be corrected, supplemented, blocked or deleted. Blocking takes the place of erasure if there are legal obstacles to erasure (e.g. statutory retention obligations).

What does "joint responsibility in public transport" mean?
Brienz Rothorn Railway AG is responsible for processing your data. As a public transport company, Brienz Rothorn Railway AG is required by law to provide transport services jointly with other transport companies and associations ("direct transport", Art. 16 and 17 of the Passenger Transport Act). In order to make this possible, data that originates from contacting you or from your purchased services, for example, is passed on at national level within the National Direct Transport (NDV), an association of over 240 transport companies (TU) and public transport networks. The individual transport companies and associations are listed here.
The data is stored in the central database NOVA (network-wide public transport connection), which is managed by SBB on behalf of the NDV and for which we are responsible together with the other companies and associations of the NDV. NOVA is a technical platform for the sale of public transport services. It contains all the central elements for the sale of public transport services, such as the customer database. The scope of access to the shared databases by the individual transport companies and associations is governed by a joint agreement. The transfer of data and its processing by the transport companies and associations in connection with central storage is limited to the following purposes:
Provision of the transport service
Your travel and purchase data will be forwarded within NDV so that your journey can run smoothly.
Contract processing
We process this data for the establishment, administration and processing of contractual relationships.
Maintaining customer relations and support
We process your data for purposes related to communication with you, in particular to respond to inquiries and assert your rights and to identify and provide you with the best possible support in the event of concerns or difficulties across all public transport services, as well as to process any claims for compensation.
Ticket control and revenue protection
Customer and season ticket data are required and processed for revenue protection purposes (checking the validity of travel or discount cards, debt collection, combating misuse).
Incidents of travel without a valid or partially valid ticket can be recorded via the national fare evasion register.
Revenue distribution
The Alliance SwissPass office, managed by ch-integral, fulfills the legal mandate defined in the Swiss Passenger Transport Act to collect travel data for the correct distribution of revenue. The office acts as the mandate holder for revenue distribution in national direct transport on behalf of the companies that are members of the NDV.
Joint marketing and market research activities
In addition, the data collected when purchasing public transport services is also processed for marketing purposes in certain cases. If you have given your consent and processing or contact is made with you for this purpose, this will generally only be carried out by the transport company or association from which you purchased the corresponding public transport service. Processing or contact by the other transport companies and associations involved in the NDV will only take place in exceptional cases and under strict conditions, and only if the evaluation of the data shows that a particular public transport service could provide added value for you as a customer. An exception to this is processing and contacting by SBB. SBB manages the marketing mandate for NDV services (e.g. Swiss Travel Pass and Half Fare Card) on behalf of NDV and can contact you regularly in this role. We also process your data for market research, to improve our services and for product development.
Further development of public transport systems with anonymous data
We evaluate your data anonymously in order to be able to further develop the overall public transport system in line with requirements.
Customer information
For group trips, we will inform you by e-mail or telephone about the upcoming trip and any delays or cancellations. You can decide for yourself whether you wish to receive these notifications.
Support for persons with reduced mobility
SBB and public transport companies process personal data as part of their support for persons with reduced mobility. In order to provide the transportation service, we collect your personal data and contact details, as well as the nature of your disability, the aids you require and information about your journey.
The required data is passed on to the transport companies involved in the journey in Switzerland
or selected service providers - and only to the extent necessary for the provision of the
service. This includes, for example, SOS station assistance and cab service providers for shuttle replacement transportation.
Will your data be passed on to third parties?
Your data will not be sold on by us. Your personal data will only be passed on to selected service providers and only to the extent necessary for the provision of the service. These are IT support service providers, issuers of subscription cards, shipping service providers (such as Swiss Post), service providers who are commissioned to distribute traffic revenue among the participating transport companies (in particular in the course of creating so-called distribution keys within the meaning of the Swiss Passenger Transport Act), our hosting provider (see section "Use of website") and the providers mentioned in the sections on tracking tools, social plug-ins and advertisements. With regard to service providers based abroad, please also note the information in the section "Where is your data stored". In addition, your data may be passed on if we are legally obliged to do so or if this is necessary to protect our rights, in particular to enforce claims arising from the relationship between
and you. Our legitimate interest forms the legal basis for the data processing mentioned here. Your personal data will not be disclosed to other third parties outside the public transport sector. The only exceptions (to the extent described below) are SwissPass partners and companies that have been authorized by public transport companies to broker public transport services on the basis of a contractual agreement. These intermediaries will only receive access to your personal data if you wish to obtain a public transport service through them and have given them your consent for access. Even in this case, they will only have access to your data to the extent necessary to determine whether you already have tickets or travelcards for the planned travel period that are relevant to your journey and the service you require from the third party. The legal basis for this data processing is therefore your consent. You can withdraw your consent at any time with effect for the future (see section 2.8).
How are tracking tools used?
We use the web analysis services of Google Analytics for the purpose of designing and continuously optimizing our websites, apps and emails in line with requirements. Our legitimate interest forms the legal basis for the data processing described below.
Tracking on websites
In connection with our websites, pseudonymized user profiles are created and small text files ("cookies") stored on your computer are used (see below "What are cookies and when are they used?"). The information generated by cookies about your use of this website is transmitted to the servers of the providers of these services, stored there and processed for us. In addition to the data listed above (see "What data is processed when you use our website?"), we receive the following information as a result:
- Navigation path that a visitor takes on the website
- Time spent on the website or subpage
- Subpage on which the website is left
- Country, region or city from which access is made
- End device (type, version, color depth, resolution, width and height of the browser window)

Tracking when sending emails
We use third-party email marketing services when sending emails. Our emails may therefore contain a so-called web beacon (tracking pixel) or similar technical means. A web beacon is a 1×1 pixel, invisible graphic that is associated with the user ID of the respective email subscriber.
For each newsletter sent, there is information on the address file used, the subject and the number of newsletters sent. It is also possible to see which addresses have not yet received the newsletter, to which addresses the newsletter was sent and which addresses failed to receive the newsletter. In addition, the opening rate can usually be discussed, including information on which addresses have opened the newsletter and which addresses have unsubscribed from the newsletter distribution list.
The use of corresponding services enables the evaluation of the information listed above. In addition, click behavior can also be recorded and evaluated. We use this data for statistical purposes and to optimize the content of our messages. This enables us to better tailor the information and offers in our emails to the individual interests of the respective recipient. The tracking pixel is deleted when you delete the e-mail.

Google Analytics
Our website uses Google Analytics, a web analytics service provided by Google Inc, 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA and Google Iland Limited, Gordon House Barrow St, Dublin 4, Ireland respectively. Google Analytics uses methods that make it possible to analyze the use of the website, such as cookies (see below "What are cookies and when are they used?"). The information generated by a cookie about your use of this website, as listed above, is transferred to servers of Google, a company of the holding company Alphabet Inc. in the USA and stored there. The IP address is shortened by activating IP anonymization ("anonymizeIP") on this website before transmission within the member states

The information is used to evaluate the use of the website, to compile reports on the activities on the website and to provide further services associated with the use of the website and the Internet for the purposes of market research and demand-oriented design of the website. This information may also be transferred to third parties if this is required by law or if third parties process this data on our behalf. According to Google, under no circumstances will the IP address be associated with other data relating to the user.

Social plug-ins are used to make our website more personal. The plug-ins are deactivated on our website by default and therefore do not send any data to the social networks.
